Riders or passengers who were not wearing a helmet at the time of the accident may still be entitled to recover damages if another driver’s carelessness or recklessness caused the accident. South Carolina law permits motorcyclists over the age of 21 to ride without a helmet. For those riders who are under 21, the failure to wear a helmet may result in a traffic citation. However, it does not negate another’s liability for injuries resulting from an accident they caused.
