Charleston Motor Vehicle Passenger Injury Attorney

Have You Been Hurt as a Passenger in a Motor Vehicle Accident?

As you may or may not already know, you as a passenger have certain legal rights if you have been injured in a motor vehicle accident. This holds true even if the driver of the vehicle you were in is determined to be at-fault for the accident, as is often the case for accidents involving only one automobile. Since passengers are at the mercy of those around them, there exists numerous avenues for recovery to help fully compensate passengers for any injuries suffered and damages incurred. Because of this, choosing an experienced law firm, such as Hughey Law Firm, becomes that much more important. For years, our personal injury lawyers have represented passengers injured in car and motorcycle accidents throughout South Carolina.

Avenues to Recovery

There is the potential that you may be able to file multiple claims. As mentioned above, South Carolina law provides multiple avenues for recovery to help fully compensate passengers injured in motor vehicle accidents. You may be able file claims against:

  • The at-fault driver and his or her insurance;
  • Your own underinsured motorist (UIM) insurance;
  • A bar or restaurant if alcohol is involved under South Carolina’s dram shop law (see DUI-related accidents);
  • South Carolina Department of Transportation (SCDOT);
  • The vehicle manufacturer under a product liability claim;
  • And more

Did You Know?

Your personal underinsured motorist (UIM) insurance may cover you if you are a passenger in an automobile accident in the event there is inadequate insurance coverage available from the at-fault driver’s policy. This is the case because the South Carolina Supreme Court has stated that underinsured motorist coverage is “personal and portable.” Nationwide Mut. Ins. Co. v. Rhoden, 398 S.C. 393, 728 S.E.2d 477 (2012). By “personal and portable” the South Carolina Supreme Court held that underinsured motorist (UIM) coverage insures those persons listed on the insurance policy as opposed to insuring a specific car. Additionally, your underinsured motorist insurance coverage may extend to relatives living under the same roof with you, known as resident relatives.

Your Medical Bills Won’t Wait!

If you’ve filed a third-party claim but have substantial medical bills as a result of the accident and are waiting for the insurer to process your claim, you may be able to file a claim for medical payments. You have the right to file for medial payments under your automobile policy. Any third party settlement would be reduced by any amounts you may receive from your own policy.
