## South Carolina Personal Injury Law — Key Facts


- **Statute of limitations:** Generally three years from the date of the accident.
- **Comparative negligence:** Modified rule — damages reduced proportionally by the claimant's percentage of fault. Claimants more than 50% at fault cannot recover.
- **Damages available:** Economic (medical bills, lost wages, property damage) and non-economic (pain and suffering, loss of enjoyment, loss of consortium). Punitive damages capped at three times actual damages or $500,000, whichever is greater.
